Welcome to <em>Faith, Law, and Legacy with Abed Awad<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is our second episode, and we&#8217;re going to discuss a basic guide to Islamic inheritance Islamic inheritance law 101.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I&#8217;m going to try to simplify one of the most complex sciences. The Prophet Muhammad, sallallahu alayhi wasallam, said that <em>ilm al-fara&#8217;id nisf al-din<\/em> the science of inheritance and <em>fara&#8217;id<\/em> is half of religion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a very important area for a faith-aligned, ethical lifestyle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When we talk about the Sharia, what is ultimately the framework of the Sharia? It&#8217;s God&#8217;s divine compass for Muslims to lead an ethical lifestyle. That&#8217;s the ultimate goal of the Sharia: to have an ethical and moral lifestyle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One part of that is trying to align your financial circumstances, estate planning, marriage, and business within the parameters of an ethical and moral lifestyle aligned with those values.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Islamic Inheritance and the Development of Knowledge<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When we look at the Islamic law of inheritance and Chapter 4 of the Quran, Surat An-Nisa, we find all of the fractions associated with inheritance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Believe it or not, the science of algebra was created by Muslim scholars to solve inheritance questions and mathematical formulas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So much of what Muslims produced in knowledge had a lot to do with our way of living a moral and ethical lifestyle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Think about astronomy, <em>ilm al-falak<\/em>, and time. Much of that scientific inquiry by Muslim scholars involved finding ways to answer practical questions: How do we find the <em>qibla<\/em> when we pray? When do we know when it&#8217;s Asr? When do we know when it&#8217;s Isha?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Muslim scholars became mathematicians, physicists, and astronomers to create answers that made it easier for Muslims to practice their faith.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Think about the complexities of inheritance and its contributions to mathematics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With that introduction, let&#8217;s talk about Islamic law of inheritance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Islamic Inheritance Works<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Islamic law of inheritance is what we would call an intestacy system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means your estate has to be distributed according to a fixed-share system a forced heirship system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The scholars said that you do have control of up to one-third of your estate. You could use one-third of your estate to give to other beneficiaries, while two-thirds of your estate are to be distributed according to the shares found in Surat An-Nisa in the Quran.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I will make references between Shiite law, Ja&#8217;fari law, and Sunni law on some of these items because it&#8217;s important for Muslims of different denominations to learn about their Islamic inheritance rules.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The One-Third Rule in Sunni and Ja&#8217;fari Law<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For Sunnis, that one-third cannot be given to an actual heir who is already taking under the inheritance rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if I pass away and leave behind a wife, a son, and a daughter, my wife will get one-eighth, and the balance will be distributed between my two children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The daughter will get half the share of the son. I&#8217;m going to have an episode explaining why the half-share evolved and the reasons the Quran articulated this difference between a brother and a sister.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this example, I cannot take that one-third and give it to my wife because my wife is already an heir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s the <em>la wasiyya li warith<\/em> tradition in Sunni law. If an Islamic heir is already taking under the intestacy rules, they&#8217;re not entitled to anything extra.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ja&#8217;fari law takes the opposite position.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Ja&#8217;fari law, that one-third can be used to give to your wife, your daughter, your son, or whoever you want. You can give that extra one-third to an heir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Three Categories of Islamic Heirs<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Sharia divides Islamic inheritance into three categories.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Ahl Al-Fara&#8217;id: The Obligatory Heirs<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The first category is called <em>Ahl Al-Fara&#8217;id<\/em> the obligatory heirs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The obligatory heirs include family members such as the mother, father, brother, sister, daughter, son, grandmother, and grandfather.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each has a specific prescribed share under the Islamic inheritance framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you pass away, the applicable shares of these heirs are segregated from your estate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, let&#8217;s say you pass away with a wife and a mother.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your wife may receive one-eighth. Your mother may receive one-sixth or one-third, depending on the circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But what happens to the balance?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s where we come to the second category.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Ta&#8217;sib: Residuary Takers<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The second category involves taking by <em>Ta&#8217;sib<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These are residuary takers people who take from the balance of the estate after the prescribed shares have been distributed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, consider a circumstance where a daughter and grandfather survive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The daughter is going to take one-half. The grandfather will take one-sixth. Where does the balance go?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may go to the paternal line, depending on who else is surviving.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If we had a daughter, a son, and a surviving mother, the mother gets her one-sixth, and the balance goes to the daughter and son by <em>Ta&#8217;sib<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Mithl al-hadh dhakar unthayayn<\/em> the male receives the share of two females.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a list of people who are eligible to take by <em>Ta&#8217;sib<\/em>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Dhawil Arham: The Maternal Line<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The third category is <em>Dhawil Arham<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This looks at the maternal line.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This category becomes relevant when you have no one in the first category of <em>Ahl Al-Fara&#8217;id<\/em> and no one in the <em>Ta&#8217;sib<\/em> category. You then go to the maternal line.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is very rare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In my 27 years of practice, I&#8217;ve never had this circumstance. In most cases, it&#8217;s difficult not to have someone, even a distant relative from the paternal line, who would take the remainder of the estate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it&#8217;s important to know that there is this other category called <em>Dhawil Arham<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These are the three categories that cover the Islamic law of inheritance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rad and Awl in Islamic Inheritance<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are also doctrinal tools, including the concepts of <em>rad<\/em> and <em>awl<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes the prescribed fractional shares leave an extra amount to be distributed. In those circumstances, certain heirs may have their shares proportionately increased with the remaining balance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the total of the shares exceeds one more than 100% adjustments can also be made proportionately so that the complete distribution equals 100%.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These are tools that the scholars developed to address the mathematical distribution of an estate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Ja&#8217;fari Inheritance Law Works<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On the Ja&#8217;fari side, Islamic inheritance law is approached differently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ja&#8217;fari inheritance creates three classes of takers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first class includes children, parents, and spouses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If there&#8217;s a child, whether male or female, in class one, they can block people in subsequent classes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You only go to the second class when there&#8217;s nobody in the first class.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second class includes brothers, sisters, nieces, and nephews.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If there are no qualifying survivors in class two, you then go to class three, which includes uncles and further generations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sunni and Ja&#8217;fari Inheritance Compared<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Sunni Sharia and Ja&#8217;fari Islamic inheritance systems have similarities as well as important differences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When it comes to the prescribed Quranic shares, Shi&#8217;i and Sunni law share important common ground because those percentages come directly from the Quran.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The differences arise in areas such as how the remainder is addressed, how an extra balance is distributed, and how the blocking rules operate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if you pass away and have a wife and a daughter, under Sunni law, the wife is going to receive one-eighth and the daughter one-half. The balance may then go to other eligible relatives, depending on who survives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you die with a mother, daughter, and son, the existence of the surviving son can block siblings from inheriting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Shi&#8217;i jurisprudence, the blocking rules operate differently.
