These laws vary from state to state.<\/p>\n<p>Generally, if you die without a will and leave behind a spouse and children, your assets will be divided between your surviving spouse and children. If you die married without any children, your wife may inherit the entire estate. Your parents in most states will not inherit if\u00a0 you have surviving children.
