{"id":70,"date":"2020-01-04T00:01:59","date_gmt":"2020-01-04T00:01:59","guid":{"rendered":"http:\/\/192.168.1.147\/shariawiz\/?p=70"},"modified":"2025-11-13T19:57:35","modified_gmt":"2025-11-13T19:57:35","slug":"what-does-radd-mean","status":"publish","type":"post","link":"https:\/\/shariawiz.com\/halaqa\/2020\/01\/04\/what-does-radd-mean\/","title":{"rendered":"What does radd mean? | Islamic Estate Planning Guide"},"content":{"rendered":"<p><iframe loading=\"lazy\" title=\"Shariawiz: The Islamic inheritance Doctrine Of Radd\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/qEWoSlAt0Lo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p><em>Radd<\/em> literally means \u201creturned to.\u201d When the total of the prescribed shares does not exhaust the entire estate, the balance left in the estate will be distributed according to either the Islamic law doctrine of <em>radd<\/em> (increasing the shares proportionately) or <em>ta\u02bfs\u012bb<\/em> (where eligible heirs take the balance remaining in the estate).<\/p>\n<p>If there are no residuary heirs, the Islamic doctrine of <em>radd<\/em> is used to increase the share of each Qur\u2019anic heir proportionately.<\/p>\n<p>An example of <em>radd<\/em> is when the survivors are a mother and one daughter: the mother\u2019s prescribed share is 1\/6 and the daughter\u2019s prescribed share is 1\/2. After the take their shares, there remains a 1\/3 balance in the estate but no residuary heirs to take it. So the mother and daughter\u2019s shares will be increased proportionately with the doctrine of <em>radd<\/em>: the mother will receive 1\/6 + [1\/4 x 1\/3] = 1\/4 and the daughter will receive 1\/2 + [3\/4 x 1\/3] = 3\/4.<\/p>\n<p>But\u2014if in addition to the mother and daughter\u2014a full brother survives, <em>radd<\/em> will not apply\u2014and it becomes a <em>ta\u02bfs\u012bb<\/em> matter. As shown in the first example,<em>,<\/em> the brother will receive the balance remaining in the estate (1\/3).<\/p>\n<p>Remainder rules exclude spouses from taking more than their predetermined share. However, there is authority that says if there are no other Islamic heirs in category 1 and 2 (<em>t<\/em><em>a\u02bfs\u012bb<\/em> through self and <em>ta\u02bfs\u012bb<\/em> derived through another), then the spouse is entitled to take the remainder.<\/p>\n<p>Again, when the predetermined share that Islamic heirs take is not 100% of the estate, the remainder must be distributed according to the remainder rules, either <em>radd<\/em> or <em>ta\u02bfs\u012bb<\/em>.<\/p>\n<p>Does <em>radd<\/em> apply to your estate?
