{"id":538,"date":"2021-12-20T17:48:38","date_gmt":"2021-12-20T17:48:38","guid":{"rendered":"https:\/\/www.shariawiz.com\/halaqa\/?p=538"},"modified":"2025-11-13T21:08:38","modified_gmt":"2025-11-13T21:08:38","slug":"about-islamic-trusts-waqf","status":"publish","type":"post","link":"https:\/\/shariawiz.com\/halaqa\/2021\/12\/20\/about-islamic-trusts-waqf\/","title":{"rendered":"What is a public waqf (Islamic Charitable Trust)? | Islamic Estate Planning Guide"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Waqf:\u00a0 (Pl: Awqaf\/waqfs)\u00a0 \u00a0a Waqf Literally means to stop, contain, or to preserve.\u00a0 \u00a0According to the Sharia, a Waqf is a voluntary, permanent, irrevocable dedication of a thing or of part of wealth \u2013 in cash or kind \u2013 to Allah.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Once a waqf is created, ownership of the corpus of the waqf belong to Allah and will never be gifted, inherited, or sold.\u00a0 \u00a0The benefit (manf\u2019a) of the waqf may be used to support any Shari\u2019ah compliant purpose.<\/span><\/p>\n<p><strong>A waqf can be created:\u00a0\u00a0<\/strong><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> In a person\u2019s lifetime as a inter vivors gift, which becomes effective immediately.\u00a0 \u00a0 \u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> At a person\u2019s death as a testamentary endowment \/ gift, which becomes effective upon death.\u00a0 \u00a0\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">There are more restriction to the testamentary waqf:\u00a0 &#8211; may not exceed one-third of a person\u2019s net assets\u00a0 &#8211; may not be made in favor of a legal heir.<br \/>\n<\/span><span style=\"font-weight: 400;\">In most Waqf deeds, the maker explains the reason for the Waqf :\u00a0 <\/span><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">The maker is seeking \u201cthe face of God the Almighty and the abundance of His momentous reward.\u201d\\\u00a0 Followed by \u201cWe waste not the wage of one righteous in works.\u201d\u00a0 Qur\u2019an 18:30<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Waqfs for schools and mosques and hospitals are standard.\u00a0 \u00a0 Mansur Qalawun Waqf for a hospital in Egypt survived 600 years but here is some examples of waqf reflecting the sophistication of Islamic charitable giving and planning: Waqfs for widow and divorcees Wqafs for feeding and caring for animals Waqfs for china\/dinner ware Waqfs for clothing the poor and loaning jewlery Waqfs help orphans marry Waqfs for aging horses Waqfs to free prisoners Waqf to entertain the sick in hospitals\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The waqf (plural awqaf) was the most permanent form of charitable giving.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With the affects of the waqf lasting long after the initial act of creating, the waqfs sustained Islamic institution building from hospitals, to mosques, to schools, to feeding and sheltering the poor.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Muslims have waqfs that survived for more than 600 years. The waqf that Mansur Qalawun created to establish a hospital in Egypt in the 13<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> century survived well into the 19<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> century.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Despite the importance of individual almsgiving and providing assistance to the poor, the charitable act <\/span><i><span style=\"font-weight: 400;\">par excellence<\/span><\/i><span style=\"font-weight: 400;\"> in Islamic tradition was and continues to be the waqf. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">A person sets aside a property as a waqf which legally means that said property is inalienable in perpetuity. It was dedicated to the cause of God (<\/span><i><span style=\"font-weight: 400;\">fi sabeel illah<\/span><\/i><span style=\"font-weight: 400;\">) and became a property of God (<\/span><i><span style=\"font-weight: 400;\">haqq Allah<\/span><\/i><span style=\"font-weight: 400;\">).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Again, Islamic charity is God-centric. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Historians are examining endowment documents as a source for the social history of Islamic societies. In <\/span><i><span style=\"font-weight: 400;\">Waqfs and Urban Structures<\/span><\/i><span style=\"font-weight: 400;\">, Richard Van Leeuwen found that the waqf institution was a determining factor in the growth and structure of Muslim cities both on the level of political and economic control and on the level of social cohesion.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is not surprise then that almost 75 percent of arable land in the area of today\u2019s Turkey, one-fifth in Egypt, one-seventh in Iran, one-half in Algeria, one-third in Tunisia, and one-third in Greece were held in waqfs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The institutionalization of charity in Islam was part of building the Islamic civilization and maintaining economic equity and a safety net for the poor.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>What does the Quran say about Islamic Waqf (trusts).\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Expend from what We provided you before death befalls any of you and then he says: &#8216;My Lord, if only You held me back a little while, I would have given in charity and been among the virtuous.&#8217;\u00a0\u2014 Qur&#8217;an 63:10.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Charitable giving in Islam is God-centric. Muslims give lillah\u2014to God or for God.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The obligation to comply with the divine moral virtue of giving is not an act of altruism or generosity because the poor and those in need actually have \u201ca rightful share\u201d in a Muslim\u2019s wealth. <\/span><span style=\"font-weight: 400;\">The Prophet (PBUH) said that: \u201cWhen a person dies, all of his or her good deeds end, except three of them \u2013 a Sadaqah Jariyyah (an ongoing charity), knowledge that benefits people or a righteous child who prays for him or her.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With this divine moral foundation, it is not a surprise that Muslims were and continue to be the most charitable people.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Guillam Postel, a 16th century French scholar and mystic observed during his travels through Muslim lands that charity for Muslims was a way of life:\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You find poor people who have nothing to give understood that offering help to people consists not only of food and drink, but all kinds of needs: some spend their life time repairing bad roads by bringing stones, wood, filling holes . . . others . . . bring water to the road and they invite the passerby to drink . . . . And these kinds of people are most respected among the Muslims because they send their charity to paradise ahead of them.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With a crystal clear directive to be virtuous in the Quran combined with numerous <\/span><i><span style=\"font-weight: 400;\">ahadith<\/span><\/i><span style=\"font-weight: 400;\"> of the prophet (PBUH), Muslim scholars built an entire jurisprudence governing charitable giving, including the development of the waqf \u2013 which was the most important institution \u2013 not only for charity \u2013 but for building safety nets for communities and cities all over Muslim lands.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Umar said [to the Prophet], \u201cO Messenger of God, I have acquired property that is dear to me.
