What does that actually mean? | Islamic Estate Planning Guide"},"content":{"rendered":"<p><em>Ma\u1e0f\u0101hib<\/em>\u00a0(<em>ma\u1e0fhab <\/em>singular<em>)<\/em>\u00a0are\u00a0Shar\u012b\u02bfa\u00a0doctrinal schools.\u00a0In the 7th century, Muslim juristic knowledge started as study circles (<em>halaqas<\/em>) in which a pious Muslim scholar &#8211; surrounded by people &#8211; would debate religious issues and teach interested students.\u00a0Without an ecclesiastical hierarchy, there was no institutional monopoly over divine truth or divine intent by any scholar. This environment fostered and actually encouraged different interpretations of the law.\u00a0The knowledge and production of legal doctrine began in these circles that gave birth to the\u00a0<em>Ma\u1e0f\u0101hib<\/em>\u00a0(Shar\u012b\u02bfa doctrinal schools).<\/p>\n<p>This legal pluralism provided flexibility and the ability by design to accommodate different societies and regions. It is believed that dozens or even hundreds of different scholars established their own doctrinal schools or schools of law with students\u00a0and followers. By the 11th or 12th century, these schools went through a process of consolidation and\/or extinction due to objective political, social, economic, and intellectual factors which led to only four surviving schools in Sunni law:\u00a0\u00a0\u1e24anaf\u012b, Sh\u0101fi\u2019\u012b, M\u0101lik\u012b, and \u1e24anbal\u012b.<\/p>\n<p>In most intellectual centers around Muslim lands, these doctrinal schools thrived. It was not unusual that you would have a \u1e24anaf\u012b scholar teaching while another Sh\u0101fi\u2019\u012b scholar is teaching another <em>halaqa<\/em> at the same mosque. The Ottoman Empire adopted the \u1e24anaf\u012b school as the Empire\u2019s doctrinal school. For this reason, it became well-entrenched in Muslim lands. But that did not eliminate the other schools from thriving and taking root all over the Muslim world.<\/p>\n<p>The Arab Persian Gulf countries follow the \u1e24anbal\u012b School of Law; North Africa, such as Morocco, Tunisia, and Algeria, follow the M\u0101lik\u012b School of Law; Sunni Muslims in Turkey, Iraq, Egypt, Syria, India, Pakistan, and Afghanistan as well as Central Asia tend to follow the \u1e24anaf\u012b School of Law. Palestine, East Africa, Indonesia, and Southeast Asia predominantly follow the Sh\u0101fi\u2019\u012b School of Law.<\/p>\n<p>The schools do have differences with respect to U\u1e63\u016bl al-Fiqh and different <em>fiqh<\/em> rulings on numerous matters. In the area of inheritance, with the exception of whether a paternal grandfather would block siblings, and the differences in the inheritance distribution in the special cases, the Islamic inheritance rules according to the \u1e24anbal\u012b, \u1e24anaf\u012b, M\u0101lik\u012b, and Sh\u0101fi\u2019\u012b <em>ma\u1e0f\u0101hib <\/em>(schools) are by and large the same.<\/p>\n<p>Where the survivors are siblings and a paternal grandfather, the siblings and the paternal grandfather will share together according to the \u1e24anbal\u012b, M\u0101lik\u012b, and Sh\u0101fi\u2019\u012b schools. Unlike the \u1e24anbal\u012b, M\u0101lik\u012b, and Sh\u0101fi\u2019\u012b schools, in the \u1e24anaf\u012b school, the paternal grandfather would block siblings from inheritance. Similarly, the \u1e24anaf\u012b, \u1e24anbal\u012b, M\u0101lik\u012b, and Sh\u0101f\u2019\u012b schools differ with respect to inheritance distribution in certain rare special cases.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Learn what it means when your dad says he follows the Hanafi ma\u1e0fhab for Muslim Americans.
