Qur\u2019anic heirs take a predetermined share\u2014either one-half, one-quarter, one-eighth, two-thirds, one-third, or one-sixth. They are: Four males: Husband, maternal brother, father, and paternal grandfather Nine females: Wife, daughter, son\u2019s daughter, mother, paternal grandmother, maternal grandmother, full sister, maternal sister, and paternal sister.<\/li>\n<li>Residuary heirs (taking by <em>ta<\/em><em>\u02bf<\/em><em>s\u012bb<\/em>). If there is anything left in the estate after the Islamic heirs take their prescribed shares, the residuary heirs inherit the balance. They do not have a fixed share. The residuary heirs are ranked in order of priority. For example, a son and daughter take any balance remaining after the prescribed shares. If there are no children, then the siblings take the balance remaining, if there are no siblings, then the nephews take the balance remaining and so forth.<\/li>\n<li><em>Dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m.<\/em>If no Qur\u2019anic or\u00a0<em>ta<\/em><em>\u02bf<\/em><em>s\u012bb<\/em>\u00a0heirs survive (a rare occurrence), then the estate goes to\u00a0<em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em>. The most common translations are \u201cdistant kindred,\u201d \u201cuterine heirs,\u201d or \u201couter family.\u201d While spouses are Qur\u2019anic heirs, they are not eligible to receive any balance or residue left if the estate is not exhausted, so the remainder of the estate will pass to distant kindred if there are no other Qur\u2019anic heirs or residuary heirs.<\/li>\n<\/ol>\n<p>If there are no surviving Qur\u2019anic heirs or\u00a0<em>ta<\/em><em>\u02bf<\/em><em>s\u012bb<\/em>\u00a0heirs (residuary heirs), the \u1e24anbal\u012b, \u1e24anaf\u012b, and Sh\u0101fi\u2019\u012b schools will distribute the estate to\u00a0<em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em>. The M\u0101lik\u012b school, on the other hand, will distribute the estate to the public treasury. Modern M\u0101lik\u012b scholars, however, have concluded that in the absence of a true Islamic government, such as in the United States, the estate will be distributed to\u00a0<em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em>.<\/p>\n<p>There is no exact English translation for\u00a0<em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em>. The most common translations are \u201cdistant kindred,\u201d \u201cuterine heirs\u201d or \u201couter family.\u201d\u00a0<em>Al-r\u1e25\u0101m<\/em>\u00a0(plural: Al-\u02bear\u1e25\u0101m) means \u201cto have mercy, compassion or sympathy.\u201d In the Qur\u2019an, it means \u201ca familial relationship.\u201d (Qur\u2019an 4:1. Fear God in Whose name you make requests one of another, and sever not the ties of kinship [Al-\u02bear\u1e25\u0101m]. God watches well over you.). Juristically,\u00a0<em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em>\u00a0refers to relatives that are not Qur\u2019anic heirs or <em>ta<\/em><em>\u02bf<\/em><em>s\u012bb<\/em> heirs (residuary heirs). While spouses are Qur\u2019anic heirs, they are not eligible to receive\u00a0<em>radd<\/em>\u00a0if there are other surviving Islamic heirs.<\/p>\n<p>Muslim scholars divided a <em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em>\u2013specific relative into one of three categories:<\/p>\n<p><strong>1. Descendants of daughters:<\/strong><\/p>\n<p>Children of your daughters and their children;<\/p>\n<p>Children of your son\u2019s daughters and their children;<\/p>\n<p><strong>2. Descendants of your father<\/strong><\/p>\n<p>Children of sister (both full or paternal) and their children<\/p>\n<p>Daughters of brothers (both full or paternal) and their children<\/p>\n<p>Children of maternal brother and their children<\/p>\n<p>Daughters of male nephews (full and paternal) and their children<\/p>\n<p>Maternal uncle \u2013 the decedent\u2019s father\u2019s brother from his mother, decedent father\u2019s uncle, decedent\u2019s grandfather\u2019s uncle from his mother; and their children<\/p>\n<p>Aunt (full, paternal or maternal), including decedent\u2019s father\u2019s aunts or grandfather\u2019s aunts and their children<\/p>\n<p>Daughters of uncles (full, paternal or maternal) and their children<\/p>\n<p>Daughters of the son\u2019s of uncles (full, paternal or maternal) and their children<\/p>\n<p>Father\u2019s mother\u2019s father<\/p>\n<p>Mother\u2019s father\u2019s father\u2019s father<\/p>\n<p>Father\u2019s mother\u2019s mother\u2019s father\u2019s father<\/p>\n<p>Farther\u2019s mother\u2019s father\u2019s father\u2019s father<\/p>\n<p>Father\u2019s mother\u2019s mother\u2019s father<\/p>\n<p>Father\u2019s mother\u2019s father\u2019s father\u2019s mopther\u2019s father<\/p>\n<p>Farther\u2019s mother\u2019s father\u2019s father<\/p>\n<p>Mother\u2019s mother\u2019s father\u2019s father\u2019s father<\/p>\n<p>Mother father\u2019s father\u2019s father\u2019s father<\/p>\n<p>Aunt\u2019s aunt (sharing father or sharing mother)<\/p>\n<p>Father\u2019s uncle (sharing mother)<\/p>\n<p>Grandfather\u2019s uncle (sharing mother)<\/p>\n<p><strong>3. Decedent\u2019s of your Mother <\/strong><\/p>\n<p>Mother\u2019s siblings and their children (full, paternal or maternal)<\/p>\n<p>Mother\u2019s mother\u2019s siblings and their children (full, paternal or maternal)<\/p>\n<p>Father\u2019s mother\u2019s siblings and their children<\/p>\n<p>Mother\u2019s aunts and uncle and their children<\/p>\n<p>Father\u2019s aunts and uncles and their children<\/p>\n<p>Mother\u2019s aunts and uncles and their children<\/p>\n<p>Mother\u2019s father\u2019s father\u2019s father<\/p>\n<p>Mother\u2019s father\u2019s fathers\u2019 mother<\/p>\n<p>Father father\u2019s mother\u2019s mother<\/p>\n<p>Father\u2019s father\u2019s mother\u2019s mother\u2019s mother<\/p>\n<p>Mother\u2019s Father\u2019s mother<\/p>\n<p>Mother\u2019s father\u2019s mother\u2019s mother<\/p>\n<p>Mother\u2019s father\u2019s father\u2019s mother<\/p>\n<p>There are three scholarly opinions on how to divide the estate to <em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em> beneficiaries.\u00a0 The <em>\u02be<\/em><em>ahl al-r\u1e25\u0101m<\/em> method divides the estate equally between all of the <em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em>, irrespective of gender or generational class. The majority of scholars, however, have since rejected this opinion, despite its simplicity.\u00a0 The <em>\u02be<\/em><em>ahl\u02be<\/em><em>l-tanzil<\/em> method divides the estate using distribution by representation. This means that a relative in the <em>dhaw\u016b<\/em><em>\u02be<\/em><em>l l-ar\u1e25\u0101m<\/em> group steps into the shoes of the Qur\u2019anic heir or residuary heir relative and inherits what that relative would have inherited had he or she survived the decedent. The standard inheritance rules of prescribed shares, residue, and blocking apply. The \u1e24anbal\u012b, M\u0101lik\u012b, and Sh\u0101fi\u2019\u012b schools adopted this opinion.\u00a0 The <em>\u02be<\/em><em>ahl qaraba<\/em> method divides the estate using distribution per capita. With distribution per capita, heirs of the same generation will each receive the same amount.
